Pyhrn-Priel ActiveCard and Pyhrn-Priel SeasonCard 

The following terms and conditions apply for the issue and use of the Pyhrn-Priel Active and the Pyhrn-Priel SeasonCard.

Definition
All persons who have lawfully purchased the Pyhrn-Priel SeasonCard have the right to make use of all included services of the associate partners  without any extra costs. The Pyhrn-Priel ActiveCard allows all persons, staying at a card-inclusive accommodation establishment during the Card-season and in possession of a registration card, to use the designated services and facilities of the partner establishments of the Pyhrn-Priel ActiveCard. The included services are listed in detail in the brochure “Wer card, der spart” (Holiday on Card – more for less) In addition there are discounted services also listed in detail in the accompanying brochure.

Range of services/liability exclusions
All of the Pyhrn-Priel ActiveCard and Pyhrn-Priel SeasonCard partner establishments mentioned in the accompanying brochure have agreed to offer their Card designated services unrestricted, on a unlimited scale to the Pyhrn-Priel ActiveCard and Pyhrn-Priel SeasonCard holders (in consequence mentioned as Card holders) in accordance with their terms of use and general business conditions. The Card holders should note that the opening hours / operating times of some partner companies do not cover the entire duration of the card season, mainly due to weather and seasonal conditions. Longer waiting periods might also be expected due to limited capacities in some instances. Card holders must comply with the indicated opening times and also agree to adhere to any possible restrictions of admission or capacity limitations of the relevant companies. Card holders also waive any rights to compensation for any offered services not being available or only partly available due to operational problems or any unforeseen circumstances whatsoever. The service partners are liable only for gross negligence and intent, but not for slight negligence. In addition there is no liability for any personal items of clothing or valuables. The Card holders should please note that the Pyhrn-Priel Tourism GmbH is entitled to terminate agreements with individual card service partners for important reasons even during the season and therefore the card holder may not lay any claims whatsoever to unused or unavailable services.

Conditons of issue
for the Pyhrn-Priel SeasonCard:
The Pyhrn-Priel SeasonCard can be ordered at all info-offices of the region or at any partner company per telephone, fax, e-mail or in person. The Pyhrn-Priel Tourism GmbH sends out the issued card by mail as fast as possible together with a brochure listing all services, terms and conditions of use and an invoice. The Pyhrn-Priel SeasonCard is valid as soon as payment is received and a passport photograph of the holder is pasted onto the card with the protective foil provided.

for the Pyhrn-Priel ActiveCard:
Each inclusive accommodation establishment has agreed to inform every guest, regardless of his length of stay, about the Pyhrn-Priel ActiveCard. The guest receives from his accommodation owner the blue copy of the official registration form, stating the duration of stay as is required by the local authorities, as well as the Pyhrn-Priel ActiveCard. Only in exceptional cases will the Pyhrn-Priel ActiveCard be issued by one of the authorized places of issue. In that case the signed blue copy of the official registration form and the production of identification will be required.

Non-transferability/loss of card
The Pyhrn-Priel ActiveCard and Pyhrn-Priel SeasonCard are not transferable. The Pyhrn-Priel SeasonCard is only valid with the passport photograph of the owner pasted into the card.  The Pyhrn-Priel ActiveCard is only valid in conjunction with a valid Photo ID. The Card may therefor only be used by the person whose name and identification number is stated on the card. In the event of non-use of the Pyhrn-Priel ActiveCard or Pyhrn-Priel SeasonCard no replacement can be provided. In the event of loss of a Card the Pyhrn-Priel Tourismus GmbH has to be informed immediately. The old card becomes invalid as soon as a new card has been issued.

Validity
The Card season for the year 2008 starts on the 17th May and ends on the 12th October. The Pyhrn-Priel SeasonCard „More Summer“ is valid during the entire period. The Pyhrn-Priel ActiveCard „More Holiday“  is valid within these dates from the date of issue to the guest's departure date. The card is not rechargable and can be discharged once invalid.

Purchase of card
The relevant rates for the Pyhrn-Priel SeasonCard are published in the official brochure and on www.saisoncard.com. In addition to the seasonal fee, a once-off processing fee for shipping and activation of the card will be charged. The Pyhrn-Priel ActiveCard is not available for free sale. Only guests staying and registering in an inclusive accommodation establishment are eligible to use the card.

Children
Pyhrn-Priel SeasonCard: Children born on or between 17th May 1993 and 17th May 2002 can make use of the reduced card fee during the Summer Season 2008.
Pyhrn-Priel ActiveCard: may be issued to all persons over the age of 6 up to 14 years of age who are listed in the official registration card as accompanying children.

Conditions of use
In order to make use of the advantages of the card the card holder must produce his Pyhrn-Priel ActiveCard or Pyhrn-Priel SeasonCard, which will be checked by the Card business partner using either a card reader or by visual inspection and recording of the card number and the cardholder's name to ensure validity and check identity. The cardholder is obliged to show proof of identification when requested. If he cannot do so, free admission can be denied.

Damage
In the event of damages to or technical difficulties with the Pyhrn-Priel ActiveCard or Pyhrn-Priel SeasonCard, the guest should contact his accommodation provider or any official place of issue, who will be able to exchange the damaged card for a new one.

Misuse
In the event of misuse or the suspicion of misuse of the Pyhrn-Priel ActiveCard and Pyhrn-Priel SeasonCard, business partners are entitled and obliged to withhold the card without replacement. A complaint will be filed upon misuse or well grounded suspicion of misuse. The cardholder is liable for misuse of the card by third parties. In the event of theft or loss he is obliged to report this occurrence to the Pyhrn-Priel Tourism GmbH under the telephone number (+43/7562/5266). There is no entitlement to a replacement card or a reduction in purchase fees.

Liability exclusions of Pyhrn-Priel Tourismus GmbH
Pyhrn-Priel ActiveCard and Pyhrn-Priel SeasonCard holders (in consequence mentioned as Card holders) should note, that the Pyhrn-Priel Tourism GmbH's only acts as a facilitator between the Card holders, the relevant partner companies and the inclusive accommodation establishments. The Card holders waives any conceivable claim for damages or guarantees, regardless whether the service partner or accommodation property is at fault or not, the more so as none of the card partner establishmments are assistants of the Pyhrn-Priel Tourismus GmbH. The Card holder is not eligible for compensations from Pyhrn-Priel Tourismus GmbH in the event of any services mentioned in the brochure not being provided by any of the partner companies.

Court of Jurisdiction
Any disagreements regarding the use of the Pyhrn-Priel ActiveCard and Pyhrn-Priel SeasonCard or any claims, or guarantees are under the exclusive jurisdiction of the court responsible for Windischgarsten as is the exclusive application of Austrian law.
